Terms and Conditions AGREEMENT

The terms and conditions set forth in this agreement constitute the entire understanding and agreement between you (the program “participant”, “guest” or “you”) and Vita Villaggi LLC (“Vita Villaggi”, “we”, “us”, or “our”) with respect to any and all reservations or transactions made with Vita Villaggi.

By making a reservation, you accept all of the terms and conditions in this agreement including the waiver of liability and direct us to perform services on your behalf.

PRICING: INCLUSIONS; EXCLUSIONS; AND PAYMENT

INCLUSIONS

The price of the program is in US dollars.  It is based on a double occupancy and includes accommodations, meals, excursions, gratuities, and ground transportation to and from the excursions specified in the itinerary for your program.  It also includes ground transportation from Naples Capodichino Airport on the first day to the accommodation specified in the itinerary and to Naples Capodichino Airport from the accommodation specified in the itinerary on the final day. 

A single supplement payment applies if a single accommodation is requested, subject to availability.

EXCLUSIONS

The price excludes items not expressly listed above, including, but not limited to, airfare, personal expenses, travel insurance, airport fees, airline baggage fees, additional hotel services (e.g., room service, laundry, telephone calls), drinks (e.g., additional drinks, upgraded wine selections), meals not included in the itinerary, taxes and similar fees, and any other expenses not included in the itinerary.

PAYMENTS

Payments due are in US Dollars and can be made via credit card¹ at vitavillaggi.com or by check. Please make check payable to VITA VILLAGGI LLC and mail it to 15 Pearl St., Clinton, CT 06413

For example, if the program price were $5,000, the payment schedule would be:
-$500 when making the reservation;
-$2,250 due 90 days prior to the start date (50% of the remaining balance); and
-$2,250 due 45 days prior to the start date (remainder of the balance).

Vita Villaggi and its suppliers reserve the right to substitute accommodations, eating establishments, or other services set forth in the program with comparable services.

REFUNDS AND CANCELLATIONS

Cancellations by you Before Start Of Program

To cancel a reservation, please email us at vitavillaggi@gmail.com.  Please include your name and the program you are cancelling.  Alternatively, you may call us at 860-532-0277.

As noted below, the purchase of comprehensive travel insurance to protect against unforeseen circumstances, including trip cancellation, is strongly recommended.

If any refund is due, it will be processed using the original payment method.

Alterations by you to the Program Dates

If your arrival or departure date changes for any reason that is beyond the control of Vita Villaggi, including, but not limited to, airline delays, changes in airline schedules, travel documentation issues, health or vaccination issues, or personal choice, the program fees will not be altered as the price is for the package rather than individual services. Refunds and credits are not available for services not used. Additionally, you will be responsible for payment and arranging of transportation to bring you to meet the group if you arrive late or leave the group if you depart early.

Cancellations by Vita Villaggi

Vita Villaggi reserves the right to withdraw and/or cancel a program or to make changes in the itinerary and hotel accommodations whenever, in its sole judgment, conditions warrant. If a program is cancelled, due to a foreseeable reason, a full refund of payments made will be provided, which will constitute full settlement of any claims you may have against Vita Villaggi or its suppliers, travel intermediaries, or partners.  If a program is canceled due to an unforeseeable reason or a reason beyond the control of Vita Villaggi (e.g., acts of God, flood, fire, weather conditions, civil commotion, riot, insurrection, war, government restraint, political disturbance, acts or threats of terrorism), credit toward a program scheduled within the next calendar year will be given.  If a guest cannot attend any of the programs offered within the next calendar year, a refund will be given of the paid program price minus 10%.

ACTIVITY LEVEL

This is a moderately active to active program. It requires climbing stairs, often steep and narrow and sometimes without handrails, walking a mile or so, walking on different surfaces including cobblestone streets, farmland, and up hills, and standing for an hour or two. Elevators are not common and are not found in the historical buildings we will be staying in during our programs.

Please keep in mind that hotels and transportation providers, outside of the United States are not required to comply with ADA requirements and therefore most often do not have ramps, wide entryways or elevators to accommodate the disabled, or devices such as wheelchairs, walkers, and motorized scooters.  As our programs are outside the United States, the accommodations and transportation will not be ADA compliant.

Vita Villaggi cannot provide individual services such as assisting with walking, pushing a wheelchair, or helping with getting in and out of minibuses or cars. To participate in any of our programs, guests must be able to participate unassisted in the activities. If the guest’s continued participation is not possible for whatever reason, expenses, including cancellation fees and/or costs for alternate travel plans or to return home, will be the responsibility of the guest. All unused services are non-refundable.

TRAVELER’S RESPONSIBILITIES

Passport and Visa

Guests are responsible for ensuring that they have the proper travel documents, including passports valid for at least 6 months beyond the dates of travel, and any visa requirements.

HEALTH RESTRICTIONS, E.G., Vaccinations

Guests are responsible for any vaccinations required and for compliance with all health restrictions, including COVID-19 requirements.

Travel Insurance

We strongly recommend that each guest purchase comprehensive travel insurance.  Travel insurance can help with medical coverage for illness or injury, trip cancellation and/or interruption, baggage loss, medical evacuation, and more.  

Special Requests

Please notify Vita Villaggi of any food allergies and/or dietary restrictions such as gluten free or vegetarian when making the reservation for the program. You may email us, or you may include it when making the reservation in the “Allergies/Dietary Restrictions” section. Please note that while a vegetarian diet can typically be accommodated, we may not be able to accommodate a vegan diet. Vita Villaggi will make reasonable efforts to accommodate food allergies and/or dietary restrictions but cannot guarantee that will be possible.

Authority to Decline or Remove Guests

Vita Villaggi reserves the right to accept or reject any person as a guest.  Vita Villaggi reserves the right to remove any guest from the program when, in our sole judgment, continued participation would adversely affect the guest, the other guests, or the interests of the program.  Expenses, including cancellation fees and/or costs for alternate travel plans or to return home, will be the responsibility of the guest. All unused services are non-refundable.

Photos and Videos

Vita Villaggi may use, re-use, and reproduce any images, photos, or videos that are sent to us or are taken by us for promotional or commercial use without any compensation to guest. Guests who prefer that their images or recordings not be used must notify Vita Villaggi before the start of the program they are participants of.

Assumption of Risk

As a guest of Vita Village programs, I am aware I am undertaking activities that require at least moderate activity levels such as walking through different terrains as cobblestone streets, farmland, and ancient ruins. I am aware that weather conditions may be adverse and/or unpleasant. I accept the risks and uncertainty involved being a participating guest in this program. I acknowledge that Vita Villaggi is not responsible for evaluating my fitness to participate in any activity and that the decision of whether to participate in any activity is mine alone. I accept and assume full responsibility for any and all risks of illness, injury, or death, and of the negligence of Vita Villaggi and agree to hold harmless and release Vita Villaggi from claims of third-party negligence.

I understand the physical requirements of the activity in which I will be participating, and I currently have no known physical, medical or mental condition which would impair my ability to participate in this program or my safety in this activity, and I am willing to assume all risks that may be created, directly or indirectly, by any such condition.

I understand that I will bear the costs of any medical condition or injury sustained, including a medical evacuation.

RELEASE FROM LIABILITY 

Vita Villaggi does not own or operate any entity which provides goods or services for your program. These entities include lodging facilities, transportation companies including buses and vans, food and food service providers, entertainment providers, etc. All such persons and entities are independent contractors. As a result, Vita Villaggi is not liable for any negligent or willful act or failure to act of any such person or entity, or of any other third party.

Without limitation, Vita Villaggi is not responsible for any injury, loss, or damage to person or property, death, delay or inconvenience in connection with the provision of any goods or services occasioned by or resulting from, but not limited to, overbooking or downgrading of accommodations, structural or other defective conditions in hotels or other lodging facilities, mechanical or other failure of transportation means, dangers incident to recreational activities such as but not limited to walking, climbing stairs, etc., food poisoning, lack of access to or quality of medical care, difficulty in evacuation in case of a medical or other emergency, illness, epidemics, pandemics, volcanic eruptions, environmental pollution/contamination, inclement weather, earthquake, flooding, power shortages/outages, government health advisories, terrorism, political unrest, acts of war, or the threat thereof, acts of God, acts of government, force majeure, or for any other cause beyond the control of Vita Villagi. In addition, I release Vita Villaggi from its own negligence and assume all risk thereof.

LIMITATION OF REMEDIES

The sole remedy for any breach by Vita Villaggi LLC under this agreement shall be the refund of the program cost paid. Vita Villaggi shall not be liable to any guest for any emotional distress, mental anguish or psychological injury of any kind. In no event shall Vita Villaggi or its members, managers, employees or agents be liable for any indirect, consequential, incidental or punitive damages (including but not limited to damages for lost profits, loss of revenue, loss of use, loss of contract or other opportunity, for any other consequential or indirect loss or damage of a similar nature).

GOVERNING LAW AND JURISDICTION

Vita Villaggi bookings are deemed to be contracts made in the state of Connecticut and are governed by Connecticut law. All disputes and matters whatsoever related to, arising under, in connection with or incident to reservations or transactions made with Vita Villaggi or these Terms shall be resolved exclusively by the state and federal courts located in Connecticut. Vita Villaggi and each guest hereby consents to the exclusive jurisdiction of such courts and waives any jurisdictional, venue or other objection that may be available. Each guest hereby knowingly and voluntarily waives a trial by jury.
